Thank you for shopping with Niemann Foods, Inc. (“Niemanns”, “we”, “our” or “us”). We operate grocery stores under the brand names Niemanns, Country Market, Harvest Market, and Haymakers (collectively, the “Niemanns Stores”).
We value our customers and respect their privacy, so we have developed this privacy policy (“Privacy Policy”) to provide you with information about how we collect, use, store, disclose, and share your Personal Information, including when you visit our websites located at https://www.niemanns.com/, https://www.mycountymarket.com/, https://www.goharvestmarket.com/, and https://www.gohaymakers.com/ (collectively, our “Sites”), shop at our stores, use our mobile or web applications (the “Apps”) or information we collect from other sources.
UPDATES: WE MAY UPDATE THIS PRIVACY POLICY FROM TIME TO TIME. IF WE MAKE MATERIAL CHANGES, WE WILL PROVIDE A NOTICE AT THE TOP OF THIS PRIVACY POLICY, AT THE TOP OF THE SITES AND APPS, OR OTHERWISE COMMUNICATE CHANGES TO YOU. ALL CHANGES WILL BE EFFECTIVE IMMEDIATELY UPON POSTING TO THE SITES OR APPS.

1. WHAT IS PERSONAL INFORMATION?

“Personal Information” means information that identifies, relates to, describes, is reasonably capable of being associated with, or could reasonably be linked, directly or indirectly, with a particular consumer. Personal Information does not include publicly available information or aggregated or de-identified information.

We may collect the following categories of Personal Information from or about you in connection with our business and have provided examples of such data elements below:

  • Contact information and identifying information: First name, last name, current and previous mailing address, email address, current and previous telephone number, birthdate, and similar information.Account information: Username, password, account number, account activity, Max Card number, and similar information.
  • Customer records: Information about your purchases and returns. Please note that we do not collect or store credit or debit card information from you when you make a purchase, but we may receive back the last 4 digits of your payment card number from our PCI-compliant third-party payment processor to confirm your purchases.
  • Internet activity and other electronic data: IP address, browsing history, and information regarding your interaction with our Apps and Sites, online identifiers like cookie ID, browser type, your internet service provider, operating system, device ID, and date and time you used the Apps or Sites. Please see our Cookie Policy for more information on how we collect information about your internet activity and other electronic data.
  • Imprecise Geolocation Data: Imprecise location information, such as your zip code or city associated with your IP address and Max Card account. When you enable location services on our Apps, we will collect and use location data, including the real-time geographic location of your device with your consent.
    Health insurance information: Information contained on your insurance card, including insurance policy number.
  • Biographical and demographic information: Your age, gender, and similar information if you are a Max Card member.
  • Sensory Information: Video images we collect from the use of security cameras in our stores and parking lots.
  • Job Application Information: Your professional or employment-related information and any educational information when you apply for a job.

3. SOURCES OF PERSONAL INFORMATION:

We collect Personal Information from the following sources:

A. Personal Information You Provide to Us.

We collect Personal Information that you provide to us directly, when you visit the Niemanns Stores, use our Sites and Apps, use your Max Card, or otherwise communicate with us.

B. Personal Information We Collect Automatically Using Technology.

When you use our Apps or visit our Sites, we automatically collect certain Personal Information using certain software tools, including cookies. Please see our Cookie Policy for more information.

C. Personal Information We Collect from Third Parties.

We may collect certain Personal Information about you from third parties. These third-party sources include our service providers, business partners, shipping and fulfillment providers, payment processors, marketing, targeted advertising and analytics providers, and other third parties that provide us services for the purposes described in this Privacy Policy. We may also collect Personal Information about you from our social media sites, the internet, and other public or commercial sources.

4. THE PURPOSES FOR WHICH WE COLLECT PERSONAL INFORMATION

We collect and use Personal Information for the following purposes:

  • Customer Service: Our primary goal in collecting Personal Information is to provide you with a great customer experience and to answer your questions.
  • Communications: To communicate with you about new products, new offerings, store events, discounts, and to send you announcements, newsletters, coupons or other promotional materials, to provide you with electronic coupons and to provide you with surveys and process your responses.
  • To Operate our Customer Loyalty Programs: We collect your Personal Information in operating our premium card and loyalty card programs, including the Max Card, Haymakers, myCountyMarket, and Payback Club Cards, to issue rewards points and allow you to redeem rewards.
  • Order Fulfillment: To accept, process, fill and deliver your orders.
  • Store Locator: We use your Personal Information to help you find our nearest Niemanns Stores, gas stations, or pharmacies when you enable location services on your mobile or desktop device.
  • Credit Applications: To complete credit applications.
  • Sweepstakes: To allow you to participate in contests, sweepstakes, or other promotional activity and to process and deliver contest entries and rewards.
  • User Content: To allow you to post a review or comment on any part of our services or post other user-generated content on any part of our Sites.
    Pharmacy Services: To operate our Health Mart pharmacy, to fill your prescriptions and to provide flu shots.
  • Pet Medications: To operate our pet prescription plan and to assist you in purchasing pet medications.
  • Marketing and Advertising: To advertise or market our Niemanns Stores, products and services to you, including to deliver direct mail, email, mobile messages, social media notifications and other electronic marketing communications, to serve you with personalized advertising, and to conduct market research.
  • Analytics: To analyze your use of our Sites to improve the functionality and your experience of the Sites. We use such information to provide security for our Sites and our Apps, to prevent fraud, to track user trends, and to analyze the effectiveness of our services and offerings.
  • To Operate and Improve our Sites and our Apps: To provide you with our Apps and our Sites and to enable visitors to our Sites and Apps to enjoy and easily navigate them.
  • Operate and Secure our Business: To operate our business and to prevent fraud in the Niemanns Stores and on our Sites and Apps.
  • Job Applications: To process and evaluate your job applications.
  • Business Transactions: To evaluate and conduct potential business transactions.
  • Legal Purposes: To protect the rights of the Niemanns Stores, our employees and customers, to protect our property and our rights; to ensure the technical functionality and security of the Apps, Sites, and the Niemanns Stores; to carry out our obligations and to enforce our rights arising from any contracts, including, but not limited to, any contracts between you and us; and to comply with applicable law, assist law enforcement, and to respond to regulatory or other legal inquiries.

5. THOSE WITH WHOM WE SHARE OR DISCLOSE YOUR PERSONAL INFORMATION

A. Our Service Providers.

We may disclose your Personal Information with services providers so that we can operate our business and deliver you the highest quality customer experience. For example, we may share your information with service providers who assist us in performing core functions related to our operation of the Sites, the Apps or the Niemanns Stores, such as website hosting, application development, marketing, to help manage our Max Card and other rewards program, to process payments, technical support, customer support, data storage, and security, or to make certain interactive online tools available to you as a user. These service providers are required to maintain the confidentiality of your Personal Information and not to use it for their own marketing purposes.
Rosie: We use the services of Rosie to provide you with the convenience of ordering groceries online and to either pick them up at the store or have them delivered to your door.
Instacart: Customers can access the services of Instacart through our website. Instacart connects consumers with personal shoppers who can visit our store and deliver the products you purchase to your door.

B. Third Party Analytics and Advertising Partners.

We use third parties to perform analytics regarding your use of our Sites and Apps and to provide us with analytical and statistical reports about the use of our Sites and Apps on a deidentified basis.
We use third parties to serve targeted advertising to you, develop marketing materials, communicate with you about our offerings, notify you of new products and programs to enhance our marketing capabilities, and inform our marketing and communication plans and strategies. C. Business Partners.

From time to time, we may partner with other companies to jointly offer products or services. If you purchase or specifically express interest in a jointly-offered product or service from us, we may share information collected in connection with your purchase or expression of interest with our joint promotion partner(s). We do not control our business partners’ use of the information we collect, and their use of the information will be in accordance with their own privacy policies.

D. Our Affiliates.

We may share your information with our affiliates.

E. Pharmacy and Healthcare Providers; Business Associates.

We may share your Personal Information with your healthcare provider, your authorized agent, a relative, or our business associates (as defined by HIPAA) in connection with your use of our pharmacies.

F. Professional Advisors.

We may share Personal Information with our professional advisors, such as our attorneys, accountants, financial advisors, insurance agents and business advisors, in their capacity as advisors to us. These professional advisors are required to keep your Personal Information confidential.

G. Employment References and Background Checks.

We may disclose or share your Personal Information in connection with an employment application to verify the information you provide and to perform background checks.

H. In the Event of Merger, Sale, Change of Control, or other Business Transaction.

If we are involved in a potential business transaction, including a due diligence process, merger, asset sale, financing, corporate divestiture, reorganization, or acquisition of all or some portion of our business to another company or if we undergo liquidation, bankruptcy, restructuring or other similar proceedings, we may share your Personal Information in connection with such transaction. In certain cases, once the transaction is completed, we may transfer that Personal Information to be used by the new owner or successor at the end of the process and that Personal Information will be subject to the new owner or successor’s own privacy policy, which may differ from this Privacy Policy.

I. Government Officials, Law Enforcement, or for Other Legal or Security Reasons.

We may disclose Personal Information about you if we have a good faith belief that disclosure of such Personal Information is reasonably necessary to: (i) comply with any applicable law, regulation, legal process, subpoena or governmental request; (ii) enforce our Terms of Use, our Rewards Programs or other applicable agreements, including investigations of potential violations of those Terms of Use; (iii) detect, prevent, or otherwise address fraud or security issues; or (iv) protect against harm to the rights, property and safety of our company, our employees, customers, visitors, service providers or the public.

J. With Your Consent.

At your direction or request, or when you otherwise consent, we may share your Personal Information with a third party.

6. YOUR PRIVACY CHOICES

We offer several ways for you to control how your Personal Information is collected, used, disclosed or shared:

A. Contact Us.

You may contact us to update or delete your Personal Information using the information in Section 12 below.

B. Update or Delete Your Max Card Account.

You can update your Personal Information by accessing your Max Card account. If you no longer wish to use your Max Card or access your account or account information, you may request for us to delete your Max Card account by contacting us using the information in Section 12 below. This will result in full, permanent deletion of your Max Card account. We will not be able to recover your Max Card account after it has been deleted, and you will not be able to use any points or rewards associated with that account.

C. Update Your Browser Settings.

Most internet browsers automatically accept cookies. You can disable this function by changing your browser settings, but disabling cookies may impact your use and enjoyment of the Sites and the Apps. You cannot disable all cookies, such as cookies that are essential to the functioning of the Sites and the Apps. Changing your settings with individual browsers or ad networks will not necessarily carry over to other browsers or ad networks. D. Use Digital Advertising Tools.

You can change your preferences with respect to certain online ads and learn more about third-party ad networks and online behavioral advertising by visiting the National Advertising Initiative Consumer opt-out page or the Digital Advertising Alliance Self-Regulatory Program.

E. Opt out of Our Marketing Messages and Push Notifications.

If you have signed up to receive marketing messages from us, you can stop receiving those messages by taking the following steps:

  1. Email. If you no longer wish to receive future promotion or advertising emails from us, you can select the “unsubscribe” link at the bottom of the email you receive from us or contact us using the information in Section 12 below. Please note that even if you opt out of receiving the promotion and advertising emails, we may still send you a response to any “Contact” request as well as administrative, maintenance and operational emails (for example, in connection with a password reset request or placement of an order).
  2. Push Notifications: You may elect to receive push notifications from our Apps. If you no longer want to receive push notifications, you may adjust your notification settings in your App account or phone settings.
  3. Text Messages. If you know longer which to receive text messages, you can enter “Stop” using the link on your text message.

7. RETENTION

We will retain any Personal Information as long as it is needed to: (i) fulfill the purposes for which we collected the Personal Information, and (ii) comply with applicable law.

8. DATA SECURITY

We take the protection of your Personal Information seriously and take reasonable and appropriate physical, administrative, and technical measures to protect your Personal Information from unauthorized access or acquisition. If we learn of any unauthorized access or acquisition of Personal Information, we will notify you of a breach if required under applicable law.

9. CHILDREN'S PRIVACY

Our Apps and Sites are not intended for or directed to individuals under 16 years of age, and we do not knowingly collect any Personal Information from children under the age of 16. If you are a parent or legal guardian and learn that your child has provided us with Personal Information without your consent, please contact us and we will make commercially reasonable attempts to delete such information.

10. LINKS TO OTHER WEBSITES

The Apps and Sites may link to websites that we do not maintain or control. Niemanns is not responsible for the privacy or security policies or practices of any of those third-party websites. The inclusion of any link does not imply our endorsement of any other company, its sites, products, or services. If you choose to access third-party websites using a link, you do so at your own risk. We suggest you read the terms and conditions and privacy policies for each website that you visit.

11. SOCIAL MEDIA, ADS, AND PLUG-INS

We engage with guests on multiple social media platforms (e.g., Facebook, X, Instagram, Tik Tok, and LinkedIn). On certain social media platforms, you have the ability to contact us or otherwise direct us to communicate with you via social media. In addition, we may contact you via direct message or use other social media tools to interact with you. These features may require us to implement cookies, plug-ins, and application protocol interfaces (APIs) provided by those social media platforms to facilitate those communications and features.
We cannot control any policies or terms of any social media third-party platforms. Your use of social media is governed by the privacy policies and terms of the third parties that own and operate those websites and not by this Privacy Policy. We encourage you to review those policies and terms. As a result, we cannot be responsible for any use of your information or content by a third-party platform, which you use at your own risk.

  • The Trade Desk Universal Pixel: We use the Universal Pixel from The Trade Desk to send targeted advertising to visitors of our Sites. SOCIAL MEDIA 

We are active on social media sites and engage with customers and guests on multiple social media platforms (e.g., Facebook, X, Instagram, Tik Tok, and LinkedIn). On certain social media platforms, you can communicate with us via social media. In addition, we may contact you via direct message or use other social media tools to interact with you if you post on social media. In these instances, your interactions on social media sites are governed by the social media provider’s privacy policy.

Our Sites and Apps may use social media plug-ins (e.g., the Facebook “Like” button) to enable you to easily interact with certain social media websites (e.g., Facebook) and share information with others. When you visit our Sites or use our Apps, the operators of the available social media plugins can place a cookie on your device enabling such operators to recognize individuals who have previously visited our Sites. If you are logged into these social media websites while visiting our Sites or using our Apps, the social media sites will receive information that you have visited our Sites or other information.
